Supplemental Security Income, known as SSI, for individuals who have limited or no earning history. SSI is a welfare, needs-based benefit, so you must have minimal earnings and assets to qualify.

SSDI is not means-tested. You can be a millionaire and still get SSDI benefits. The amount of the benefits is based on how much you paid into the SS system during your working years.

When you call the Social Security Administration to ask about disability benefits, they will determine whether you meet the non-medical requirements for these programs and process your application accordingly. There are also special rules for benefits that may be payable to disabled widows and children. Pursuing an application for Disability or SSI can be a long process. The medical requirements are the same for both programs.

Applying for SSI typically involves three steps:

  • Step One – You file a disability application, wait about six months. Then, get denied.
  • Step Two – You file a Request for Reconsideration, wait about another six months, and get denied again.
  • Step Three – You Request a Hearing before an Administrative Law Judge. It usually takes 12-16 months to get the hearing date after you request it. Your chances of winning in front of the Judge are approximately 50%. If you have an attorney representing you, you are even more likely to be successful.

Having good medical evidence is essential to winning your claim. It is important to be working with a doctor who understands your limitations and supports your claim. Benefits are awarded if your condition “meets or equals” the listing of impairments that have specific requirements, or if your condition is such that a review of your age, education, and past work experience, along with your current limitations, makes it impossible for you to return to any employment.
