SSI is a welfare, needs based benefit so you must have minimal earnings and assets in order to qualify. When you call the Social Security Administration to ask about disability benefits, they will determine whether you meet the non-medical requirements for these programs and will process your application accordingly. There are also special rules for benefits that may be payable to disabled widows and children.

Pursuing an application for S.S. Disability or SSI can be a long process. The medical requirements are the same for both programs. It is typically three steps:

  • Step One – You file a disability application, wait about six months and then get denied.
  • Step Two – You file a Request for Reconsideration, wait about another six months and get denied again.
  • Step Three – You Request a Hearing before an Administrative Law Judge. It usually takes 12-16 months to get the hearing date after you request it. Your chances of winning in front of the Judge are approximately 50%. If you have an attorney representing you, you are even more likely to be successful.
